Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PhantomProxies (the “Service”), operated by PhantomProxies (“we”, “us”). By creating an account or purchasing bandwidth, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service provides
PhantomProxies sells prepaid residential proxy bandwidth, measured in gigabytes (GB). When your payment succeeds, we provision a set of proxy credentials for you and allocate the purchased amount of bandwidth to them. Traffic you send through those credentials is routed over a third-party residential proxy network that we purchase capacity from.
You are buying an allocation of bandwidth, not dedicated IP addresses, specific locations, or guaranteed throughput. The composition of the underlying IP pool changes constantly and is outside our control.
2. Eligibility and accounts
- You must be at least 18 years old and legally able to enter contracts.
- Accounts are created through Discord or Google sign-in. You are responsible for the security of the third-party account you sign in with.
- You are responsible for all activity conducted through your proxy credentials. Treat them like a password. Do not resell, share, or publish them.
- One person or business per account. We may merge or suspend duplicate accounts.
3. Acceptable use
You may use the Service for lawful purposes only. You agree that you will not use the Service to:
- Violate any applicable law, regulation, or sanctions regime.
- Gain unauthorized access to any system, account, or network, including credential stuffing, brute-forcing, or exploiting vulnerabilities you are not authorized to test.
- Conduct denial-of-service attacks, send spam or unsolicited bulk messaging, or distribute malware, phishing pages, or fraudulent content.
- Transmit, access, or distribute child sexual abuse material, content that incites violence, or material that infringes intellectual property rights.
- Commit payment fraud, carding, identity theft, or launder proceeds of crime.
- Intercept, monitor, or interfere with traffic belonging to other users of the network.
- Resell, sublicense, or provide the bandwidth to third parties as a proxy service of your own.
Some uses of proxies are lawful but may breach the terms of the websites you connect to. You are solely responsible for evaluating and accepting that risk. We do not monitor the contents of your traffic, but we will act on credible abuse reports.
4. Enforcement
We may suspend or terminate your access immediately, without refund, if we reasonably believe you have breached Section 3, if our upstream network provider requires it, or if required by law. Where the breach is minor and correctable, we will normally contact you first.
5. Pricing and payment
- All prices are in US dollars and are shown before purchase.
- Payments are processed by Stripe. We never receive or store your full card details.
- Purchases are one-time. There is no subscription, recurring charge, or auto-renewal.
- You are responsible for any taxes applicable in your jurisdiction unless we are required to collect them.
6. Delivery and bandwidth balance
Bandwidth is provisioned automatically once Stripe confirms payment. This is usually immediate, but may be delayed by payment review or upstream provider issues. If provisioning fails, the purchase is marked failed in your dashboard and we will either retry or refund it.
Your remaining balance shown in the dashboard is read from the upstream network and reflects measured usage. Bandwidth consumption is measured by that provider, and its measurements are authoritative for billing purposes.
7. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
8. Availability and support
We do not guarantee uninterrupted availability. The Service depends on third parties (our upstream proxy network, payment processor, and hosting provider) and may be affected by their outages. Any performance figures we publish are indicative of the underlying network and are not a service-level guarantee.
9. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, that any particular website will be reachable, or that any particular geographic location will be available at any given time.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of your use of the Service.
Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months preceding the event giving rise to the claim.
11. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or demand (including reasonable legal fees) arising from your use of the Service or your breach of these Terms.
12. Changes to these Terms
We may update these Terms. Material changes will be reflected in the “Last updated” date above, and continued use after a change constitutes acceptance. If you do not accept a change, stop using the Service; unused bandwidth remains subject to the Refund Policy.
13. Governing law
These Terms are governed by the laws of Indiana, United States, without regard to conflict of law rules. Disputes will be brought exclusively in the courts located in Monroe County, Indiana.
